Terms and Conditions

MatesInvest Pty Ltd (ACN 691390940) ("MatesInvest", "we", "us", "our").

These Terms and Conditions ("Terms") govern your access to and use of the MatesInvest mobile application, website and related services (the "Platform"), operated by MatesInvest Pty Ltd (ACN 691390940).

By downloading, accessing or using the Platform you agree to be bound by these Terms. Please read them carefully before using the Platform.

1. Eligibility

To use the Platform, you must:

  • be at least 18 years old;
  • have legal capacity to enter into binding contracts; and
  • comply with all applicable laws and regulations in your jurisdiction.

You must not use the Platform if doing so would breach any law or regulatory requirement that applies to you.

2. Nature of the Platform

MatesInvest is a social investing platform that allows users to share investment ideas, track portfolios, and engage with a community of investors.

Important notice

  • Information provided on the Platform is general information only.
  • It does not constitute financial advice, personal advice, or a recommendation to buy, hold or sell any financial product.
  • We do not consider your personal objectives, financial situation or needs.
  • You should obtain independent professional advice before making any investment decision.

3. Investment Risk Warning

By using the Platform, you acknowledge and agree that:

  • all investments carry risk, including the risk of loss;
  • past performance is not indicative of future results;
  • you may lose some or all of your invested capital;
  • market information provided on or through the Platform may be delayed, inaccurate or incomplete; and
  • you are solely responsible for your own investment decisions.

4. Account Registration

To access certain features of the Platform, you will need to create an account. When registering, you agree to:

  • provide accurate, current and complete information;
  • maintain the security of your login credentials and not share them with others;
  • notify us immediately of any unauthorised access to or use of your account; and
  • take responsibility for all activity that occurs under your account.

We may suspend or terminate accounts at our discretion, including where we reasonably suspect a breach of these Terms or applicable law.

5. Social Features and User Content

The Platform enables users to share investment ideas, comment on posts, and interact with other community members ("User Content"). When posting User Content, you:

  • retain ownership of your content but grant us a non-exclusive, royalty-free licence to display and distribute it on the Platform;
  • represent that your content is accurate and not misleading;
  • must not post content that constitutes financial advice, market manipulation, or is otherwise unlawful; and
  • must comply with our Community Guidelines (as updated from time to time).

We may remove User Content at any time without notice if we reasonably consider it breaches these Terms or our Community Guidelines.

6. Payments and Fees

Certain features of the Platform may be subject to fees. Where fees apply:

  • applicable fees will be clearly disclosed within the Platform prior to purchase;
  • subscription plans renew automatically at the end of each billing period unless cancelled before the renewal date;
  • fees are generally non-refundable except as required by the Australian Consumer Law or as otherwise stated at the time of purchase; and
  • we may change our pricing at any time by giving you reasonable prior notice.

7. Acceptable Use

When using the Platform, you must not:

  • use the Platform for any unlawful, fraudulent or misleading purpose;
  • post content that constitutes unsolicited financial advice or market manipulation;
  • interfere with the security, integrity or functionality of the Platform;
  • attempt to reverse engineer, copy or exploit any part of the Platform;
  • upload or transmit harmful, offensive or misleading content; or
  • use automated tools (bots, scrapers, crawlers) to access or extract data from the Platform without our written consent.

We reserve the right to remove content, restrict access or terminate accounts for any breach of this clause.

8. Intellectual Property

All Platform content, including software, branding, text, graphics, data and compilations, is owned by or licensed to MatesInvest. Nothing in these Terms transfers any intellectual property rights to you.

You receive a limited, revocable, non-exclusive, non-transferable licence to access and use the Platform for your own personal, non-commercial purposes. You must not reproduce, distribute or commercialise any part of the Platform without our prior written consent.

9. Third-Party Services and Market Data

The Platform may display market data, news or other content sourced from third-party providers, and may include links to or integrations with external services. We:

  • do not control third-party services or the accuracy of third-party data;
  • are not responsible for the content, performance or availability of third-party services; and
  • accept no liability for any loss arising from your reliance on third-party data or use of third-party services.

Your use of any third-party services is governed by that provider's terms and conditions and is at your own risk.

10. Privacy

We collect, use and disclose personal information in accordance with our Privacy Policy, which forms part of these Terms. By using the Platform, you consent to the collection and use of your personal information as described in our Privacy Policy.

Our Privacy Policy is available at matesinvest.com/privacy and should be read together with these Terms.

11. Platform Availability

We do not guarantee:

  • uninterrupted or error-free access to the Platform;
  • that the Platform will be available at all times or in all locations; or
  • that any defects will be corrected within a particular timeframe.

We may modify, suspend or discontinue any features or the Platform entirely at any time, with or without notice.

12. Limitation of Liability

To the maximum extent permitted by law:

  • we are not liable for any indirect, consequential, special, incidental or economic loss arising from your use of the Platform, including any loss of investment returns, loss of data or loss of opportunity; and
  • our total aggregate liability to you in connection with the Platform is limited to the fees paid by you in the 12 months preceding the event giving rise to the claim.

Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law that cannot be excluded, restricted or modified by agreement.

13. Indemnity

You agree to indemnify, defend and hold harmless MatesInvest and its directors, officers, employees and agents from and against any claims, liabilities, losses, damages, costs and expenses (including reasonable legal fees) arising from or in connection with:

  • your breach of these Terms;
  • any User Content you post on the Platform;
  • your misuse of the Platform; or
  • your violation of any applicable law or the rights of any third party.

14. Termination

We may terminate or suspend your access to the Platform immediately and without notice if:

  • you breach these Terms;
  • we are required to do so by law or regulation; or
  • we decide to discontinue the Platform.

You may stop using the Platform and close your account at any time. Termination does not affect any rights or obligations that arose before termination.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of Queensland, Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland for the resolution of any dispute arising under or in connection with these Terms.

Before commencing legal proceedings, we encourage you to contact us at hello@matesinvest.com to attempt to resolve any dispute informally.

16. Changes to These Terms

We may update these Terms from time to time. Where changes are material, we will notify you via the Platform or by email prior to the changes taking effect.

Your continued use of the Platform after updated Terms take effect constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you should stop using the Platform.
